MIAMI BEACH, FL — What started as a disagreement between neighbors over trash disposal at a Miami Beach apartment building took a violent turn this week, leaving a 75-year-old man injured and another under arrest on a felony battery charge.

The incident unfolded late Monday morning near the 1200 block of Normandy Drive on Normandy Isle, involving George Horton, 47, and Rodolfo Ortega, 75.

Police say Horton attacked Ortega with an electric bicycle tire and rim during a confrontation that stemmed from frustration over “the placement of garbage” outside the building, according to reports from local affiliate WSVN.

“I tell the guy, ‘Don’t touch me,’” Ortega recalled in an interview with the outlet. “He touched me, and I tried to defend [myself].” He added that the altercation “broke” his head open and claimed Horton “tried to kill me.”

An arrest report obtained by WPLG states the two men were arguing when Ortega produced a screwdriver to defend himself. That’s when Horton allegedly responded by striking Ortega repeatedly in the face, head, and body with the bicycle part, leaving the older man with visible lacerations to his head, hands, and other areas.

Surveillance footage from the area reportedly captured the incident, which police say “clearly depicts the physical altercation as described” and backs up Ortega’s account.

“I don’t have nothing with the guy, no problem,” Ortega told WSVN. “Every day I say hi.”

Despite the assault, Horton wasn’t immediately located. Police said they found him the following morning outside Ortega’s apartment door, “knocking and yelling incoherent statements,” with a strong odor of alcohol on his breath.

Horton was taken into custody and is now facing a felony charge of aggravated battery on a person 65 or older.

Police continue to investigate the incident.

Presumption of Innocence: A presumption of innocence means that any defendant in a criminal trial is presumed to be innocent until they have been proven guilty beyond a reasonable doubt in a court of law. The defendant in this case is only accused of the charges set forth in the criminal complaint. They are innocent until proven guilty.
