Affidavit of Probable Cause
On Saturday, 03-18-2023, at 1143 hours. The Wilkinsburg Police were initially dispatched to ██ Morrow Street for a large fight. Upon calling out in the area at 1148 hours I observed a large group of approximately 15 individuals actively fighting. This was aired over the radio and Officer Coffee, Sergeant Snyder, Detective Bender and several other Police agencies responded as well.
I exited my marked patrol vehicle in full uniform and attempted to break up the fight with negative results. The fight continued until enough Officers were on scene and able to separate the group accordingly. During this altercation a juvenile male later identified as James Giles refused orders and continued to physically attack others involved. Therefore he was placed into custody and placed in the rear of Sergeant Snyder’s patrol vehicle.
Now as the group began to disperse, I was approached by ███████ who informed me that her son- ███████ (juvenile) was stabbed in the left hip during this altercation, and the actor was James Giles. At this point, I observed a severe deep laceration to his left hip and advised 911 to dispatch EMS immediately. While tending to ███████ I asked if he knew who the actor was who stabbed him, when he said yes and pointed to Giles.
Several minutes later Eastern Area arrived on-scene and transported ███████ to Children’s Hospital for treatment.
After ███████’s departure ███████ informed Detective Bender and I of how the incident occurred:
Giles and his sister- ███████ arrived at their residence at ██ Morrow Street with the intent to fight her children. While Giles was calling her children outside, he picked up a brick from the roadway and shattered the right rear and front left window on her Cadillac Escalade, bearing PA registration ███████. Seconds after this all parties were in the roadway and started to fight, which continued onto Rebecca Ave.
Upon reaching Rebecca Ave, she observed Giles with a knife in his hand and actively going after ███████ before throwing the knife in an unknown direction. The area was later thoroughly searched with negative results locating the knife.
Giles was then transported back to the station before being released to the ACJ.
Presumption of Innocence: A presumption of innocence means that any defendant in a criminal trial is presumed to be innocent until they have been proven guilty beyond a reasonable doubt in a court of law. The defendant in this case is only accused of the charges set forth in the criminal complaint. They are innocent until proven guilty.
