, PA (PPP)— On March 17th, police officers responded to a gun call at an apartment on Cordell Place.

Upon arrival, they were informed by a woman that her boyfriend, Dyar Dunn, had choked her during an argument and pistol-whipped her in the face with a gun that had an extended magazine. The woman reported that she had grabbed the magazine that had fallen out of the gun during the assault and went to her neighbor’s apartment to ask for help and call the police, according to a complaint filed in magisterial district court..

The police observed the woman’s injuries and the ripped blue and white hoodie that Dunn had been wearing at the time of the assault, as well as a large amount of blood in the bathroom and loose 9mm rounds in the doorway and living room. Dunn fled the scene before the officers arrived, according to the complaint.

During their investigation, the officers received a phone call from Dunn in which he threatened to harm the woman and the police. The officers were able to overhear the conversation, according to the complaint.

Later, while attempting to make contact with the residents of another apartment, the officers observed a man who matched the description of the suspect in the assault. The man identified himself as Jermaine Upshaw, but officers observed tattoos on his forearms and hand that matched the description the woman had given of her boyfriend, Dyar Luther Dunn. After further investigation, they were able to confirm that Upshaw was indeed Dunn, according to the complaint.

Dunn was taken into custody and a search of the woman’s apartment yielded negative results for a firearm. However, officers were able to find the original blue hoodie that Dunn had been wearing in the bedroom, which was placed in a 30-day hold. A follow-up search of another apartment yielded the extended magazine and loose 9mm rounds, according to the complaint.

Affidavit of Probable Cause
On 03/17/2023 at approximately 2343hrs I, Officer O’Kelly and Unit 3313 Officers Nagy and Bogesdorfer were dispatched to ██ Cordell PL apt ██ for a gun call.

Myself and Officers Nagy and Bogesdorfer spoke to the caller ███████ who stated her boyfriend Dyar Dunn was in her apartment when a argument escalated, and Dunn grabbed her around her neck with both hands and began to choke her. A struggle began and during the struggle ███████ ripped off Dunn’s blue and white hoodie. I observed a ripped blue and white hoodie in the living room. ███████ stated Dunn then pistol whipped her in the face with a gun with a extended magazine. I observed ███████ with a busted and swollen lip with blood on her mouth. I also observed a large amount of blood in the bathroom along with loose 9mm rounds in the doorway and in the living room. After the initial incident ███████ then stated she grabbed the magazine that fell out of the gun and went to her neighbor’s apartment ██. She then gave her neighbor the magazine and asked her to help and call the police. When ███████ returned to her apartment Dunn then returned and started banging on her door, pointing the firearm at ███████ through the door hole. Dunn had left the area before our arrival; ███████ stated he was wearing the blue and white hoodie that was in her apartment along with and additional blue hoodie, gray ripped jeans, and blue and white jordans.

Medic 2 arrived on scene and cleared.

███████ stated that Dunn frequents ██ Cordell PL apt ██ and the apartments across from her building. ███████ also stated that Dunn has tattoos of a P on his hand and Dunny Sol on his forearms. While going to make contact with the residents of apartment ██ I looked into the apartment window and observed on the couch a black male wearing a white shirt, white and gray pants with white shoes sitting next to a blue hoodie. This male matched the description of the actor in relation to the assault.

While trying to make contact with the male occupant in ██, ███████ received a phone call from Dunn stating that he was going to “smoke you and the police”. Note ███████ was on speaker phone and Officers Nagy and Bogesdorfer were able to overhear this conversation.

I made contact with ███████ in apartment 620. ███████ stated that the male who was involved in the incident upstairs was at her apartment but she made him leave. When I asked her about the male on the couch she said that he was not who we were looking for and that his name was Jermaine. Eventually ███████ brought the male to the door the male identified himself as Jermaine Upshaw. The male was advised by Sgt. Davis that he is under official investigation and that failure to provide accurate information will result in a charge. After being advised the male continued to state his name is Jermaine Upshaw and would not provide a date of birth. The male was detained and I observed tattoos on his forearms and hand that matched the description ███████ gave. The male was later identified as Dyar Luther Dunn through a NCIC search.

While outside in the court yard ███████ leaned out of her window and observed the male we had detained and positively identified him as the male involved.

███████ was placed into custody at 0053hrs.

While speaking to ███████ she gave consent to search her apartment for a firearm yielding negative results. I was able to find the original blue hoodie that Dunn was wearing in the bedroom. It was placed in the 30 day hold.

Officers Nagy and Bogesdorfer conducted a follow up at apartment ██ and retrieved the extended magazine and loose 9mm rounds.

I contacted the women’s shelter at 0345hrs on 03/18/2023 and spoke to ███████. ███████ was advised of the PFA process and provided the number for the women’s shelter.
