Criminal Charges

  1. Strangulation (Felony 2)

Affidavit of Probable Cause

I am a police officer in the Commonwealth of Pennsylvania. I am currently assigned to the patrol division of the Mt. Lebanon Police Department. I am empowered by law to conduct official investigations and make arrests for offenses enumerated in the Pennsylvania Crimes Code, 18 PA C.S., Pennsylvania vehicle code 75 PA C.S., and Controlled Substances, Drug, Device and Cosmetic Act, Act 64.

On 9 APRIL 2023 at approximately 0701 hours, I was dispatched to ████████████ for a report of a domestic disturbance. Upon my arrival, I briefly met with the complainant, ████████ ██████████████████████████ ████████████████████████ ██████████████████████████. ███████ said he heard screaming and yelling coming from apartment #█ during an apparent fight and heard one party pleading with another to stop. ███████ has called the police multiple times and the MLPD was aware of an ongoing domestic situation in apartment #█ based upon multiple contacts.

I went to apartment #█ and knocked on the door. After several minutes, ███████ answered the door. ███████ is a biological male who identifies as female and prefers the name “Paris.” ███████ immediately told me his boyfriend, Gregory TUCKER, had physically assaulted him and showed me an open wound on his upper lip. ███████ said TUCKER was hiding in the closet in the back of the residence. TUCKER and ███████ were both residents of ████████████ and were involved in a continuous intimate sexual partnership.

I called out to TUCKER for some time while he remained in the rear of the residence unresponsive. TUCKER ultimately came out and spoke with me. TUCKER told me ███████ left the residence on the previous day for an extended period of time, and upon his return at approximately 2200 hours on 8 APRIL 2023 they began arguing. TUCKER was upset that ███████ was unresponsive about his whereabouts. While in the bedroom of the residence, ███████ pushed TUCKER while he was attempting to speak about the issue. TUCKER said he then blacked out and had no memory of what occurred next, however when he came to and regained his vision, he was on top of ███████ with both of his hands around his neck and was choking him. TUCKER had a small scratch on his right forearm and a small scratch on the left side of his upper chest which both appeared to be fresh. TUCKER did not have any recollection of sustaining these injuries.

I spoke with ███████, who told me he returned to the residence at approximately 2200 hours on the previous day. TUCKER became upset about his absence and was consistently attempting to talk to ███████ about the issue. ███████ said he did not engage in the conversation, which upset TUCKER further. While ███████ was sitting on the bed, TUCKER was pacing about the apartment and came in and out of the bedroom repeatedly. Suddenly and for no apparent reason, TUCKER aggressively entered the room and immediately jumped on top of ███████ and began repeatedly and aggressively asking him “do you think I’m stupid?” ███████ said he tried to push TUCKER off of him with his hands and his feet but was unsuccessful. TUCKER then put both of his hands around ███████’s neck. ███████ said he blacked out and lost consciousness during the strangulation event and had trouble breathing. ███████ struggled to breathe and complained of a sore throat afterwards. I observed an apparently fresh scratch on the inside of ███████’s left knee, an open wound on his upper tip, and a scratch on the left side of his neck.

Based upon the aforementioned facts and circumstances, it is my belief that sufficient probable cause exists to charge Gregory TUCKER, via on-view arrest, with the following violations:

PACC 2718(A)(1) – STRANGULATION
PACC 2701(A)(1) – SIMPLE ASSAULT

Presumption of Innocence: A presumption of innocence means that any defendant in a criminal trial is presumed to be innocent until they have been proven guilty beyond a reasonable doubt in a court of law. The defendant in this case is only accused of the charges set forth in the criminal complaint. They are innocent until proven guilty.
