Affidavit of Probable Cause
On 03/14/2023 at 2141 hours, I, Officer Koiat, was dispatched to the intersection of Middle St. and Thropp St. for a vehicle that just struck 2 parked cars.
While an route dispatch updated officers stating that the driver of the vehicle was now slumped over the wheel and not conscious.
Upon my arrival I observed the actor vehicle (black 2019 Chevrolet Trax with PA Plate: ███████) stopped directly behind a parked vehicle. I walked up to the actor vehicle and observed the driver/sole occupant sitting in the driver seat with the vehicle on and in park. The driver, later identified as Lamont White, was unconscious and, not responding, Officer Palinski, Unit 3129, moved around to the front passenger side window and threw a shatter ball ultimately breaking the Window allowing officers to gain access into the vehicle to render aid to White.
As soon as Officer Palinski shattered the window White immediately woke up. White was able to open the driver door and exit the vehicle under his own power. Immediately I could smell the odor of alcoholic beverage emitting from his person and I observed that this brown eyes were very bloodshot, watery, and glassy. While speaking with While I observed that his speech was mumbled and slurred.
I asked White where he was coming from and he eventually said Brighton Heights. I asked White if he knew where he currently was and he said the Northside. White continued by saying something about UPMC. It should be noted that UPMC Mercy hospital is located near downtown while AGH is approximately 5 blocks away from this location. White stated that he had a couple shots of Tequila tonight.
Based on my observations I determined that I was going to conduct SFST’s on White. I escorted White to an area away from all vehicles to conduct these tests.
The area in which these tests were conducted was a nearly flat surface with no pot holes, no cracks and was made of concrete. The current temperature outside was approximately 30 degrees Fahrenheit. White was wearing black boots, blue jeans and black sweat shirt.
I asked White if he wears any contacts or glasses to which he stated no. I then placed the tip of my pen approximately 12″ away from his nose and slightly above eye level. White agreed that he could see the tip of my pen without any obstruction.
I began to conduct the Horizontal Gaze Nystagmus. I checked for equal pupil size and equal tracking which White’s eyes jerked back and forth slightly (nystagmus). I then conducted the Lack of Smooth Pursuit which White’s eyes jerked slightly back and forth, in both eyes, while moving the tip of my pen. I conducted the Distinct and Sustained Nystagmus at Maximum Deviation test which both of White’s eyes continued to jerk back and forth slightly when the tip of my pen was at maximum deviation. I conducted the Onset of Nystagmus Prior to 45 Degrees test which both of White’s eyes jerked slightly back and forth. The final test was the Vertical Gaze Nystagmus which neither of White’s eyes had any movement other than in the upward direction following the tip of my pen. (6/6 clues)
I then conducted the Walk and Turn. I asked White to place his left foot on the straight line in front of him, followed by his right foot in front of his left, touching heel to toe. White was asked to place his hands at his side and to remain in that position until instructions were completed. I asked White if he understood to which he said yes. While in the instructional phase White loss his balance. I instructed White that he will be taking a series of 9 heel to toe steps, followed by a series of small steps turning to the left to turn around, and another series of 9 heel to toe steps back to the starting location. I then demonstrated the Walk and Turn test. I reminded White that while he is conducting this test to remember to look down at his feet, count his steps out loud, keep his arms straight down at his side, take 9 heel to toe steps, turn in the direction that he was instructed, and return with 9 more heel to toe steps. I asked White if he understood the instructions which he said yes. I instructed White that he can begin the test. White did not touch heel to toe on a number of steps, stepped offline, stopped while walking, took the incorrect number of steps, made an improper turn and raised his arms for balance. (7/8 clues)
I then conducted the One Leg Stand, I told White to stand with his feet together and arms down at his side to which he complied. I told White to remain in this position until all instructions were completed which he said he understood. I instructed White that when I tell him to start to lift one leg, of his choice, approximately 6″ off the ground. While in this position, I want him to count out loud as follows “one thousand one, one thousand two, one thousand three, etc.” until I told him to stop. I reminded White that while conducting this test I want him to look down at his feet, count out loud in the described manner, keep his arms straight down at his side, keep his foot approximately 6″ off the ground, and do not put his foot down until instructed to stop. I asked White if he understood the test which he said yes. White conducted the test which lasted 30 seconds. White stood on his left foot and raised his right fool approximately 6″ off the ground. White conducting this test White raised his arms for balance, swayed while balancing and put his foot down prior to me telling him the test was over. (3/4 clues).
Based on all the facts listed above I advised White that he was now under arrest for DUI. White was now in official police custody at 2153 hours.
Officer Palinski started to conduct an inventory of White’s vehicle since it was about to be towed. Officer Palinski located a firearm in the glove box near the front passenger seat. At this time Officer Palinski advised me of his findings to which we came to a consensus that White’s vehicle would be towed from the scene by McGann & Chester back to Zone 1 Station pending a search warrant. Officer Dickant, Unit 3111, remained on scene to have White’s vehicle towed back to Zone 1 Station.
Prior to placing White in the rear of my marked patrol vehicle, Unit 3124, I conducted a search of White’s person, search incident to arrest. I recovered 6 small corner baggies of suspected crack cocaine and a small baggie of marijuana both located in White’s front left pocket. These items were seized and placed into an evidence bag which was taken back to Zone 1 for packaging. No further contraband/evidence was recovered from White’s person.
Additional officers remained on scene and advised the owners of the vehicles that were struck of this report number and to contact their insurance companies as this was a non-reportable accident.
I transported White from the scene down to Zone 6 – SDD and met with Officer Powers, Unit 3T77. I witnessed Officer Powers read the DL-26A form verbatim to White which White agreed to submit a breath test. At 2236 hours White had a BAC of .198. I then transported White from Zone 6 down to the ACJ per PBP Policy without incident where he was accepted for incarceration.
Back at Zone 1, Officer Weaver, Unit 3110, authored a search warrant for White’s vehicle which was signed by Magisterial District Judge Tara Smith. The search warrant was executed at Zone 1 station at 2341 hours. Officers recovered the following from White’s vehicle:
Ex. 2: Taurus PT738.380 special S/N #1D061607 with 1 round in chamber and 2 in magazine located in passenger glove box by Officer Weaver.
Ex. B: (9) sandwich baggies containing marijuana located in the truck by Officer Dice.
Ex. D: Numerous pieces of indicia for Lamont White located in passenger glove box by Officer Weaver.
Ex. E: Black bag containing scale and 8 bags of marijuana located on passenger floorboard by Officer Weaver.
Ex. G: Large white plastic bag containing live ammo, empty mylar bags, and marijuana located in the truck by Officer Dice.
It should be noted that the firearm was in the passenger glove box. White’s wallet, which contained several forms of ID with White’s name and picture on them, was located sitting directly on top of the firearm.
Officer Castanzo, Unit 3125, ran the firearm (Exhibit 2) through INDEX which INDEX advised that there was no record of sale and it was not reported as stolen in NCIC. A copy of the search warrant and a copy of the receipt/inventory of seized property was left on the driver seat of White’s vehicle. White vehicle was then towed from Zone 1 Station to McGann & Chester.
Officer Palinski ran White through JNet which shows White pled guilty on 05/10/2010 under OTN: G499854-5 to Murder of the 3rd degree, firearms not to be carried without a license, criminal conspiracy, and aggravated assault making White a person not to possess a firearm.
Based on my training and experience I believe White possessed that amount of marijuana and crack cocaine in an attempt to sell these narcotics. White only possessed $54 and with the amount of narcotics in his possession, the way the narcotics were packaged, the scale and the unused marijuana packages I believe White was on his way to sell these narcotics. I also observed that White was of healthy weight, had all of his teeth, no marks on his arms, no user paraphernalia which further made me believe White was selling these narcotics and not using.
Exhibit 1 (6 small corner baggies of suspected crack cocaine) and Exhibit 2 (Taurus PT738 .380 special S/N #1D081607) will be sent to the Allegheny County Crime Lab for further testing. All other exhibits will be packaged and sent to the PBP Property Room.
