, PA (PPP)— Joseph Kennedy, a 38-year-old male, was charged with three counts of possession of firearm prohibited, a felony of the second degree. According to the affidavit of probable cause, Kennedy was found to be in possession of two rifles and a pistol with a fully loaded magazine, despite being prohibited from possessing firearms due to prior narcotics-related felony convictions.

Pennsylvania State Parole Agents had visited Kennedy’s home on a special probation visit, where they observed ammunition in plain view. Upon further investigation, they discovered two rifles and a pistol in the bedroom, and Kennedy and another individual were detained. While being questioned, Kennedy claimed that the firearms belonged to his late uncle, and his brother must have found and kept them.

Kennedy signed a consent form to search his residence, which led to the discovery of the pistol in a filing cabinet. Notably, all of the ammunition in the magazine was loaded backwards. The firearms were subsequently placed into evidence, and Kennedy was transported to Stowe Township Police Department. Kennedy’s bail was set at $15,000, and he was remanded to the Allegheny County Jail due to a court order.

Affidavit of Probable Cause
On the above date and time I was contacted by Pennsylvania State Parole for assistance at ██████████████. I arrived on scene and made contact with Parole Agent Pipik and Agent Barber. Pipik and Barber advised me that they had ███████ on special probation and during their visit they observed ammunition for firearms in plain view. Agent Barber observed two rifles in the back side bedroom. The first rifle was a Glenfield Model 60 .22 caliber and the second rifle did not have any markings whatsoever but looked as if it was In operable condition. Kennedy stated to Agent Barber that this was his brothers bedroom. Kennedy and ███████ were detained.

I arrived on scene and Kennedy agreed to speak with me. While Kennedy was speaking with me ███████ began to have multiple seizures. Officers provided aid until Northwest EMS arrived on scene and transported ███████ to Mercy Hospital. Kennedy stated that the believes the firearms belonged to his late uncle and that his brother, ███████, must have found them and kept them. I advised Kennedy that he is a person not to possess due to the fact that he was found guilt on numerous narcotics related felonies in the past and he stated that he thought that meant that he could not have a gun but others could.

Kennedy then stated that officers could search the residence for any contraband and signed a consent to search form. State Parole located another firearm, a SCCY CPX-2 9MM Pistol bearing serial number C204659 in the same bedroom that the rifles were located inside of a filing cabinet. The pistol came back to ███████. It should be noted that the pistol had a fully loaded magazine but all of the ammunition was placed in the magazine backwards. There was no other contraband located. Kennedy was allowed to get some belongings and was transported to Stowe Township Police Department.

The firearms were placed into evidence by Officer Koritsky.

I, Detective Nicolas DiMichele, respectfully request, the charges outlined in this complaint be held against Joseph Kennedy.

Presumption of Innocence: A presumption of innocence means that any defendant in a criminal trial is presumed to be innocent until they have been proven guilty beyond a reasonable doubt in a court of law. The defendant in this case is only accused of the charges set forth in the criminal complaint. They are innocent until proven guilty.
