, PA (PPP)— A 54-year-old male, Gary McAfee, has been arrested and confined in Allegheny County Jail on multiple criminal charges including carrying a firearm without a license, recklessly endangering another person, loitering and prowling at nighttime, prohibited acts, and disorderly conduct.

According to the police report, the incident occurred in the early hours of the morning on March 16, 2023, when officers were dispatched to the area of Sandy Drive after receiving a report of an unknown number of juveniles fighting in the street and hiding in the bushes. Upon arrival, the officers found no evidence of any fighting or persons in the immediate area.

Later, the police received another call reporting a burglary in progress at McGinley Drive, which is located adjacent to Sandy Drive. An officer arrived at the scene and found Gary McAfee, who claimed to be scared and being chased. The officer secured Gary and found a small caliber semi-automatic pistol in the front pocket of the sweatshirt that Gary was wearing. Later determined that Gary does not possess a Concealed Carry Weapons permit. Gary continued to make comments about being chased by other individuals as the officers attempted to get information from him as to what had transpired.

A RING doorbell video provided by the homeowner showed that Gary was pounding on the front door, holding a handgun, and discharging a round in a reckless manner, in the direction of other houses. McAfee was transported to Western Psychiatric Hospital by the officers. During the transport, multiple pills of what was believed to be Oxycodone were recovered from inside a Newport cigarette pack that was recovered from Gary’s person.

Gary McAfee was lodged at Allegheny County Jail after bail was denied.

Affidavit of Probable Cause
On Thursday, 03/16/2023, at 02:53hrs, Shaler Police Officers were dispatched to the area of ██ Sandy Dr. for a report of an unknown number of juveniles fighting in the street and hiding in the bushes. I, your Affiant, Officer Kriebel of the Shaler Township Police Department, along with my Sergeant, SGT McBurney also of the Shafer Township Police Department, arrived to the address and after canvassing the surrounding area, found no evidence of any juveniles fighting or even any persons to be in the immediate area. Officers cleared the area with negative results.

A short while later, at 04:40hrs, Shaler Police Officers were dispatched to ██ McGinley Dr. for a report of a burglary in progress. McGinley Drive is located adjacent to Sandy Drive. Officer Caldone was the first to arrive and was immediately approached by a male, later identified as Gary MCAFEE, holding his arms up and stating that he was scared and being chased. Officer Caldone secured Gary, and while doing so, located a small caliber semi-automatic pistol in the front pocket of the sweatshirt that Gary was wearing. Later determined that Gary does not possess a Concealed Carry Weapons permit. Officer Cooney arrived to the scene moments later and Gary continued to make comments about being chased by other individuals as Officers attempted to get information from Gary as to what had transpired. I, Officer Kriebel was the third Officer to arrive and after checking with the other Officers as to Gary being secured, I approached the house, ██ McGinley, and after knocking on the door, a visibly terrified elder female made eye contact with me through the window and felt safe enough to open the door to me. After calming the female, identified as ███████, explained that she was woken by repeated pounding on her front door. ███████ then explained that she checked her RING doorbell camera, and after not recognizing the male individual, she phoned 911, and the pounding continued. ███████ provided the RING doorbell video and this video clearly shows the defendant, Gary MCAFEE, running to the front door, pounding on the front door, and screaming for help. The video continues to show Gary pounding on the front door, the recovered handgun visible in his hands, and after waving the gun around, Gary discharges a round in a reckless manner, in the direction of other houses.

After medics were called, and cleared Gary at the scene, all parties involved, medics and Officers, agreed that Gary needed to be seen by a doctor. I, followed by Officer Cooney, transported Gary to Western Psychiatric Hospital. During the transport, SGT McBurney phoned me and advised that multiple pills of what was believed to be Oxycodone were recovered from inside a Newport cigarette pack that was recovered from Gary’s person.

Based on the above facts, I, your Affiant respectfully request a arrest warrant for Gary MCAFEE be issued so that Gary may answer to the charges contained within this complaint.

Presumption of Innocence: A presumption of innocence means that any defendant in a criminal trial is presumed to be innocent until they have been proven guilty beyond a reasonable doubt in a court of law. The defendant in this case is only accused of the charges set forth in the criminal complaint. They are innocent until proven guilty.
