Affidavit of Probable Cause
Your Affiant, Officer Rory Hegarty, is a Police Officer employed by the Baldwin Borough Police Department. As a certified police officer, I am entitled to enforce the laws and regulations of the Commonwealth of Pennsylvania within PA Title 18 and PA Title 75. The following is a summary of events that occurred in the 3600 Block of Willet Rd Pittsburgh, PA 15227.

On 03/12/2023, I (Officer Hegarty), was in full patrol uniform, and operating a clearly marked police car. I was observing the intersection of Willet Rd and Ganlet Rd. The intersection of Willet Rd and Ganlet Rd is equipped with a clearly marked stop sign. At 1025hrs, I observed a White Jeep station wagon fail to come to a complete stop at the clearing marked stop sign. I activated my overhead emergency lights and sirens on my police car which prompted the vehicle (PA ███████) to come to a complete stop.

I approached the vehicle on the passenger side. I made contact with the driver (later identified as Dakota Halcomb). I explained to Holcomb the reason for my stop. I then requested Halcomb hand me his license, registration and proof of insurance. When I was at the passenger side window, I was able to smell a strong odor that is consistent with Marijuana. Halcomb told me he does not have a license. Halcomb also mentioned in a spontaneous utterance that there was a firearm under the drivers seat of the vehicle. I asked Halcomb if he could step out of the vehicle. Halcomb did so. While walking from the vehicle, Halcomb mentioned in another spontaneous utterance that he had a little bit of weed on his person. I asked Halcomb if he could take the weed out of his pocket and place it on the hood of my patrol car. Halcomb did so. I was able to see a green leafy substance in a small clear plastic sandwich bag that was tied off. Due to my training and experience, I was able to confirm that the product Halcomb placed on my hood is Marijuana.

I asked Halcomb for his name and date of birth. Halcomb provided me with such, I ran his name and date of birth through CAD. I received a “Hit Check” for an Arrest Warrant from Brentwood Borough. I also noticed that Halcomb does not have a license and his drivers license was suspended. I also ran the vehicle’s registration through CAD. The vehicle’s registration has been expired since 06/2022.

Halcomb was taken into custody for the arrest warrant and transported to Allegheny County Jail by Brentwood Borough. I searched Halcomb incident to arrest. In Halcomb’s right jacket pocket, I discovered a large sum of US Currency folded together. I applied and was granted a Search Warrant for the vehicle Halcomb was driving.

Baldwin Borough Police conducted a search of the vehicle once the search warrant was granted. I was able to recover a FN .45 ACP handgun (FX3U120847) under the drivers seat. Baldwin Borough Police also recovered two loaded magazines for the handgun. One magazine was discovered in the weapon, the other magazine was discovered in the passenger seat rear pocket. The magazine that was inside the weapon was loaded with 15 hollow-point .45 cal rounds. It should be noted that this is where Halcomb stated where the firearm was located.

After reviewing Halcomb past criminal record, it was determined that Halcomb is a person not to possess due to previous convictions. It should also be noted that Halcomb does not have a valid concealed carry permit.

Due to the facts and circumstanced listed above, I believe there is probable cause for the arrest of Dakota Halcomb. Your Affiant respectfully requests an Arrest Warrant for Dakota Halcomb.

Halcomb is charged with the following:

  • PA Title 18 Section 6105 Subsection A1
  • PA Title 18 Section 6105 Subsection C2
  • PA Title 18 Section 6106 Subsection A1
  • PA Title 18 Section 6106.1 Subsection A
  • PA Title 75 Section 1543 Subsection BII
  • PA Title 75 Section 3323 Subsection B
  • PA Tile 75 Section 1501 Subsection A
  • PA Title 35 Section 780-113 Subsection A31
