Affidavit of Probable Cause
On Wednesday, 03/22/2023, Officer Dell and I, Officer Johnston, were on patrol In fully marked police SUV (#173). We were in the left turn lane of southbound Duquesne Boulevard at Center Street when a black BMW sedan passed us with an inoperable front passenger headlamp and I could not see how many occupants were in the vehicle due to illegal window tinting on the driver’s side:

I turned around and caught up to said vehicle which beared PA reg. ███████ and effectuate a traffic stop before 818 Duquesne Boulevard. I approached the driver’s side and Officer Dell approached on the front passenger side. I spoke with the driver, later identified as ███████, and advised him of the reasons for the stop (tint/headlamp out) and requested his pertinent documents. Officer Dell requested identification from the front seat passenger who was not wearing her seatbelt, later identified by her PA ID as Esabella Brilmyer, which she provided by showing Officer Dell a picture of such on her cell phone.

As ███████ searched for his pertinent documents, I observed the inspection and emission stickers (03/24) to be counterfeit. I advised ███████ of the counterfeit stickers and requested him from the vehicle and a consent pat down was performed with negative results. I advised ███████ I am requesting consent to search the vehicle for more counterfeit stickers or sticker producing equipment and advised him he can require a search warrant. When asked if I may search the vehicle ███████ stated “yes”. Officer Dell requested Brilmyer from the vehicle and she left the purse sitting at her feet in the vehicle on her own accord.

During the search I located (2) small knotted grocery bag pieces holding marijuana from the center console. I then observed a brown Louis Vuitton purse on the front passenger floorboard and observed within such after shining my flashlight into such a handgun in the main compartment. Said purse was at Brilmyer’s feet and the zipper was open approx. (1) inch and it is a zipper that does not fully enclose the opened top. Due to dispatch not advising us that Brilmyer has a concealed carry permit after Officer Dell ran her PA ID, I walked over to Brilmyer who was standing off to the side of the passenger side of the vehicle and asked her if she has a concealed carry permit and she stated “no”. I handcuffed Brilmyer and told her she is being detained due to a handgun being in her purse and she then stated the purse is her sister’s. Officer Dell detained ███████.

I advised ███████ and Brilmyer of their rights in which both stated they understood such. I asked who’s. gun is it and Brilmyer told me such is her baby daddy’s, the store owner she works for gave it to them, and she carries such for protection. I then removed the purse and made the firearm safe which is a black HiPoint C9 9mm handgun, bearing serial #P10173604, which had a round in the chamber and a loaded magazine inserted into the magazine well. The firearm was found with the magazine well facing upwards and the muzzle facing a short end of the purse.

Dispatch reported said firearm is stolen out of Pittsburgh which was later confirmed.

Officer Morris escorted Brilmyer to the rear of our cruiser, I completed the vehicle search, photographed the counterfeit stickers and removed such. I then measured the front driver’s side window tinting with a Laser Labs Enforcer II Tint Meter which provided a reading of 16% VLT. ███████ was advised the marijuana will be placed into evidence for destruction and given a warning for the traffic offenses and released.

We transported Brilmyer back to our station and she was placed in a holding cell by Officer Dell. A few minutes later I asked Brilmyer what her sister’s name is and she stated Clark and I walked away she said that the purse is not her sister’s and I confirmed the purse is hers and she said “ya”. A further search of the purse revealed a PA EBT card in the name of Esabella Brilmyer.

Brilmyer is being transported to ACJ and the seized evidence is being stored in department evidence until it is sent to the crime lab.

I respectfully request the defendant, Esabella Brilmyer, answer to the above listed charges.

Presumption of Innocence: A presumption of innocence means that any defendant in a criminal trial is presumed to be innocent until they have been proven guilty beyond a reasonable doubt in a court of law. The defendant in this case is only accused of the charges set forth in the criminal complaint. They are innocent until proven guilty.
