HOMESTEAD, FL — A South Florida man is accused of opening fire near his neighbor’s residence, sending one bullet into the home and allegedly firing additional rounds in the direction of two residents who came outside to investigate.
According to a report from WSB-TV citing Miami-Dade County records, the Miami Herald, and WPLG, Cody Richter, 29, of Homestead, was arrested Sunday on charges of premeditated attempted murder and shooting or throwing a deadly missile.
Deputies said Richter was standing outside his Homestead home when he allegedly fired a weapon and sent a 9mm bullet through the wall of a neighboring residence, striking the bathroom area inside the house.
Investigators said two people then came out of the home to find out what had happened. At that point, Richter allegedly fired in their direction. One sheriff’s office investigator said one of the neighbors could actually feel the bullets whizzing past him.
The couple retreated back into the home and called authorities. When deputies arrived, they said they saw Richter still outside and holding the weapon.
According to the arrest affidavit, Richter told investigators he had been shooting at a person who was harassing him somewhere to the right of one of the neighboring homes.
Richter was booked early Monday into the Miami-Dade Turner Guilford Knight Correctional Center, where online jail records showed he was being held without bond.
A spokesperson for the Miami-Dade Public Defender’s Office declined to comment on the case, according to the report.
Presumption of Innocence: A presumption of innocence means that any defendant in a criminal trial is presumed to be innocent until they have been proven guilty beyond a reasonable doubt in a court of law. The defendant in this case is only accused of the charges set forth in the criminal complaint. They are innocent until proven guilty.
