A man from western New York has been charged with murder after allegedly bringing his father’s body and a defense attorney to the Livingston County Sheriff’s Office earlier this week.
According to WHAM, Richard Fluegel Jr., 30, faces charges of murder, weapons possession, and evidence tampering in connection with the death of his 60-year-old father, Richard Fluegel Sr., on Sunday.
According to Livingston County Sheriff Thomas Dougherty, Richard Fluegel Sr. left his home in Irondequoit on Sunday afternoon and was reported missing. His vehicle was found the next morning in a grocery store parking lot in Dansville.
Later that evening, a 9-1-1 call was made from a man claiming to be in the parking lot with a dead body. The caller was Fluegel Jr.’s defense attorney, Brian DeCarolis, police said.
Sheriff Dougherty explained, “We have the suspect in the car with his deceased father, and in a separate car is his defense attorney, who is Brian DeCarolis.”
The attorney had received a call from Fluegel Jr. earlier in the day, asking for legal counsel and informing him that there was a body in his car.
DeCarolis is not under investigation, according to police.
Investigators believe that Fluegel Jr. shot his father twice with a 12-gauge shotgun on property in Ossean, where Fluegel Jr. is starting a legal marijuana business.
A search warrant was executed at the property on Tuesday, where authorities recovered a weapon.
Court documents reveal that Fluegel Jr. wrapped his father’s body in a tarp and placed it in his car.
Fluegel Jr., a twice-convicted felon, was denied bail after pleading not guilty. He is scheduled to return to court on Monday.
Presumption of Innocence: A presumption of innocence means that any defendant in a criminal trial is presumed to be innocent until they have been proven guilty beyond a reasonable doubt in a court of law. The defendant in this case is only accused of the charges set forth in the criminal complaint. They are innocent until proven guilty.
