I cut my teeth in journalism when I began looking into what I saw as abuses of power in my local government. From then on, I was hooked on the dopamine rush of uncovering information.

KISSIMMEE, FL — The family of one of the three men killed outside a Kissimmee Airbnb earlier this year has filed a negligent security wrongful death lawsuit, arguing that multiple parties should be held accountable for the shooting.

Douglas Kraft’s family says the case targets both the Indian Point Homeowners Association and the Airbnb owner, Marte Marcel, after the men were killed while visiting Central Florida for the Mecum Car Auction. According to WFTV, the family contends more should have been done to prevent the deadly violence outside the rental property.

Rachel Brooks, Kraft’s daughter, described her father as the force that held the family together and said the lawsuit is about more than damages. She said her father was the family’s “rock” and argued that stronger rules and better oversight were needed.

The lawsuit raises questions about whether any Indian Point HOA bylaws, covenants, conditions or restrictions were violated before the shooting. Attorney Adam Finkel of The Haggard Law Firm told WFTV that those issues are expected to be explored during discovery.

The family’s legal team also said the case is intended to pressure homeowners associations to take threats inside their neighborhoods more seriously. Attorney Michael Haggard told the station that communities need to address residents who pose an ongoing danger and use cases like Kraft’s to push for stronger protections.

WFTV reported that the Indian Point HOA said it was unaware of the lawsuit, while the Kraft family’s attorneys disputed that claim. The station said it requested the relevant HOA documents and also sought comment from the association, but had not received a response as of publication.

Presumption of Innocence: A presumption of innocence means that any defendant in a criminal trial is presumed to be innocent until they have been proven guilty beyond a reasonable doubt in a court of law. The defendant in this case is only accused of the charges set forth in the criminal complaint. They are innocent until proven guilty.
