SAN MARCOS, TX — One year after 20-year-old Alek Pacheco was killed in a downtown San Marcos shooting, his family is remembering him as an innocent bystander whose life was cut short while the criminal case tied to his death continues to move through court.

According to KVUE, Pacheco was shot and killed on July 19, 2025, after violence broke out in downtown San Marcos, and two men are still facing capital murder charges as his family continues to push for justice a year later.

Police have said Pacheco was not part of the original conflict and was instead caught in the gunfire. Another man, 24-year-old Anthony Barrera, was killed in the shooting, and a third person was hit and survived after being treated at a hospital.

Reporting from the initial investigation said the shooting happened near East San Antonio and Guadalupe streets in the early morning hours after a confrontation escalated outside a downtown bar. Authorities later arrested Jermiah Jayden Tobias and Avery Saul Bowman Jr. in connection with the case.

For Pacheco’s family, the anniversary has become both a memorial and a reminder that the case is not over. A year later, they are still mourning a 20-year-old they say was simply in the wrong place when gunfire erupted.

Presumption of Innocence: A presumption of innocence means that any defendant in a criminal trial is presumed to be innocent until they have been proven guilty beyond a reasonable doubt in a court of law. The defendant in this case is only accused of the charges set forth in the criminal complaint. They are innocent until proven guilty.
