CANTON, OH — Jury selection began Monday for two Canton police officers charged with reckless homicide in the 2024 in-custody death of Frank Tyson after video showed him handcuffed on the floor of an AMVETS post while saying he couldn’t breathe.
Camden Burch and Beau Schoenegge, both 26, are charged in the death of Tyson, 53, after officers took him down inside the club on Sherrick Road SE when two people called 911 asking that he be removed. Tyson remained facedown on the ground for minutes before officers realized he was not breathing, and he could not be revived.
According to News 5 Cleveland and News-Talk 1480 WHBC, body camera video showed an officer kneeling on Tyson’s back for about 30 seconds, the trial is expected to last at least two weeks, and roughly 30 subpoenas were issued to potential witnesses. WHBC reported the case is being heard by retired Medina County Judge James Kimbler with a visiting prosecutor handling the trial.
Tyson died on April 18, 2024, after a crash that preceded the arrest. The Stark County coroner ruled his death a homicide and also listed cocaine and alcohol intoxication and other health issues as contributing factors.
If convicted, each officer could face up to three years in prison. Tyson’s family is also suing the city for $13 million as the criminal case moves forward in Stark County.
Presumption of Innocence: A presumption of innocence means that any defendant in a criminal trial is presumed to be innocent until they have been proven guilty beyond a reasonable doubt in a court of law. The defendant in this case is only accused of the charges set forth in the criminal complaint. They are innocent until proven guilty.
