Affidavit of Probable Cause
On 03/22/2023 at approximately 17:47 Officers were dispatched to the Millvale Riverfront Park for a reported assault. Officer Anderson of Reserve Township arrived on scene first as I was tied up on another priority call. I arrived on scene shortly after and was met by a group of juveniles who stated the unknown male down on the barge, touched them inappropriately, was offering alcohol to the juvenile males, and was asking the juvenile females to help him get firewood from the woods. I then met with Officer Anderson, who was speaking with the male who was identified as David Fox by his PA ID card. Officer Anderson advised me that David did admit to touching one of the females prior to our arrival. David informed Officers that the juveniles were down on the barge, which he stated is private property, and they should not be down there. Officers did observe a small recreational fire on the barge. David advised Officers that he had been drinking and had a bottle of liquor that was by his bag. Officer Anderson located a liquor bottle by David’s bag, which contained an unknown alcoholic beverage. Officers did observe David to have blood shot and glassy eyes and the odor of an alcoholic beverage was emanating from his person. David advised Officers he was currently homeless. At this point David was placed under arrest and put in the rear of my marked Police vehicle.

I spoke with Jane Doe #1 who stated that David came up to her while they were on the barge and said she was pretty. Jane Doe #1 then stated that David was grabbing the side of her body and grabbed her buttocks. Jane Doe #1 advised me that she believed the touching to be sexual in nature and for sexual arousal. Jane Doe #1 also stated that the male seemed “drunk”.

I spoke with Jane Doe #2, who stated that David initially tried to hug her when they first came in contact with him. Jane Doe #2 stated she was sitting on the wall when David called her ‘buttons”, and then slid closer to her. David then moved Jane Doe #2’s bookbag out of the way, and began to play with the rips in her jeans, towards the upper part of her thigh, near her groin.

I spoke with Jane Doe #3, who stated that David wrapped his arm around her shoulders and asked to get closer to the fire. Jane Doe #3 also stated that David asked her to go get firewood with him in the woods. Jane Doe #3 also stated that she had a negative encounter with David at the Laundromat on Friday (03/17/2023) where she believes he stole her silver necklace.

Officer Anderson spoke with and gathered all information for John Doe #1, John Doe #2, and John Doe #3. All of them stated that David offered them alcohol and continued to try and get them to drink the alcohol.

I also spoke with two juvenile witnesses who will be identified as Witness #1 and Witness #2. They stated they were present for the entire incident.

David was then transported to the Police Station to be proceeded as per Department Policy. While in custody at the Police Station, David was speaking with Officer Harpur and made a spontaneous utterance stating, “All I did was touch the one girl on the thigh”. David also told Officer Harpur that he stated he was a “hero”, because he believed 2 of the juveniles would be having sex.

It should be noted that I also took a report earlier in the day stating that David was seen at a school bus stop this week, making inappropriate comments to juvenile females.

It should also be noted that all of the individuals involved in this incident are under the age of 18 with the exception of David. The true age and identity of these individuals are known to Officers and will be available for all future Court proceedings. Based on these facts and circumstances, I respectfully request the aforementioned charged be filed against David Fox.

Presumption of Innocence: A presumption of innocence means that any defendant in a criminal trial is presumed to be innocent until they have been proven guilty beyond a reasonable doubt in a court of law. The defendant in this case is only accused of the charges set forth in the criminal complaint. They are innocent until proven guilty.
