NEW YORK, NY — A Manhattan judge declared a mistrial may 15 in the rape retrial of Harvey Weinstein after jurors announced they were hopelessly deadlocked.
The decision marks the third time a New York court has tried the former Hollywood producer on allegations that he raped former actress Jessica Mann in 2013. The Associated Press reported that the current proceedings ended Friday afternoon during the third day of jury deliberations.
Weinstein faced one count of third-degree rape in the case. State Supreme Court Justice Curtis Farber dismissed the jury after the panel sent a note stating it could not reach a unanimous decision.
Manhattan District Attorney Alvin Bragg expressed disappointment with the outcome but thanked the panel for its service. Bragg said in a statement that his office deeply respects the jury system and will consult with Mann before choosing how to proceed.
Bragg noted that Mann has fought for justice for nearly a decade. He stated that Mann relived painful experiences in front of strangers across three separate trials.
The case has a complex legal history. A Manhattan jury first convicted Weinstein in 2020 of raping Mann and sexually assaulting former production assistant Miriam Haley.
The New York Court of Appeals overturned that conviction in 2024. The state’s highest court ruled that the original trial judge improperly allowed testimony from women whose allegations were not part of the formal criminal charges.
Prosecutors initiated a second trial in June 2025. That jury found Weinstein guilty of a first-degree criminal sexual act against Haley but deadlocked on the rape charge involving Mann, which led to the 2026 retrial.
The 2025 jury also acquitted Weinstein of an alleged criminal sexual act against actress Kaja Sokola. Weinstein has denied all allegations of non-consensual sex.
Farber previously stated he would delay sentencing Weinstein for the 2025 Haley conviction until the court reached a final resolution on the Mann charge, as per The Hollywood Reporter. Weinstein will remain incarcerated while the district attorney’s office reviews the case.
Bragg said his prosecutors will consider their next steps in relation to Weinstein’s pending sentencing for the Haley conviction. He stated the office will continue to prosecute crimes of sexual violence.
Weinstein’s representative issued a statement arguing that two deadlocked juries show significant reasonable doubt. The defense team urged the district attorney’s office to stop trying the case.
Weinstein remains imprisoned due to separate legal proceedings. A California court convicted him of rape and sexual assault in 2022, resulting in a 16-year prison sentence.
Mann issued a written statement following the mistrial declaration. She said the ruling does not change the truth of her testimony or the crimes committed against her.
Mann stated that she chose to face public scrutiny for a greater good. She added that she deserves justice and spoke out to challenge the power of predators.
Presumption of Innocence: A presumption of innocence means that any defendant in a criminal trial is presumed to be innocent until they have been proven guilty beyond a reasonable doubt in a court of law. The defendant in this case is only accused of the charges set forth in the criminal complaint. They are innocent until proven guilty.
