On January 26, 2023, at 1632 hours, Home Depot Asset Protection manager ██████████ reported to police that a retail theft had occurred at the Home Depot localed at 112 Ben Avon Heights Road, Ohio Township in Allegheny County. ██████████ provided me with a detailed Home Depot Incident report which included a narrative written by ██████████. He stated that he observed an unknown male and female enter the store with empty shopping carts. ██████████ stated that the male entered with an empty reusable Target tote bag and the female with a large flat purse. Both individuals then split up and proceeded to different parts of the store.

The following will be the actions of the female, later identified as Brittany Bailey, and will be referred to as such. According to ██████████’s narrative the follow occurred.

Bailey is seen entering the tool corral and removing her jacket and placing it over her large purse. Bailey then goes to the Milwaukee tools end cap. Bailey is then seen selecting five (5) tools and conceals them underneath her jacket, She then proceeds to the flooring section of the store where she places three of the Milwaukee tools and a battery into her purse and places the purse inside the shopping cart. She then places the larger of the Milwaukee items on top of her purse and covers it with her jacket. Bailey then exits the store through the main entrance without paying or attempting to pay for these items. Bailey then enters a burgundy in color Chevrolet sedan in the parking lot and leaves the area with the other actors.

On February 17th, 2023 at 2100 hours Officers were dispatched to Giant Eagle located at 132 Ben Avon Heights Road for suspicious activity. The caller to 911 reported a black female and a black male wearing dark colored clothing were checking unoccupied vehicles parked in the parking lot and asking people for money. The caller also believed that these two individuals were having a domestic dispute.

Sgt. Beck, Officer Botta and I arrived on scene and an employee reported that the two individuals entered Giant Eagle. Officers located the two individuals inside who stated that they were waiting for their ride. Both appeared nervous, worked up, and emotional. I spoke to the female who Identified herself as “ASHLEY Bailey” with the date of birth October 6th, 1994. While speaking with these individuals Officers were updated that Home Depot was reporting a retail theft and gave an exact description of the individuals that we were speaking to. At this time, the female attempted to walk away from us. Officer BOTTA and I detained the male and female in handcuffs and placed them in separate patrol cars due to weather conditions. It should be noted that Home Depot 132 Ben Avon Heights Drive is adjacent to Giant Eagle, 132 Ben Avon Heights Road and is only separated by two (2) parking lots.

While placing Bailey in the rear of my patrol car I recognized her to be the suspect from the previous retail theft incident at Home Depot from January 26th, 2023. Bai1ey has a large unmistakable neck tattoo on the left side. I advised her that she was under official police investigation and she continued to supply the name of “ASHLEY Bailey”. I conducted a query the name ASHELY Bailey with the date of birth provided by Bailey through my MDT which returned to a PennDOT picture that was clearly not that of female in my patrol car. When asked, she stated that she has lost weight as she could see my MDT screen from the back seat of the patrol car. It should be noted that I ran BRITTANY Bailey through my MDT Which returned with her information but did not return with active arrest warrants. It was later found that Brittany Bailey has multiple arrest warrants. It is unclear If NCIC was down during the query.

At the time of this call Home Depot was now closed for business and Asset Protection employee ██████████ was not on scene. Based on this, the female and male were identified and released pending further investigation.

I followed up with ██████████ on February 18th, he provided me with a detailed incident report. At 2040 hours, a male and female enter the Home Depot. Both individuals were wearing COVID 19 style face coverings around their mouth area. The female is seen carrying an empty rolled up white plastic bag. She is seen making her way to the De-Walt power tool section which is behind a locked security gate. She attempts to manipulate the cage in order to remove tools but it is ultimately unsuccessful. The female then goes to the end cap and selects a De-Walt tool which has a “spider alarm” around the box. This alarm can only be removed by a store employee at the checkout with a special key. She then attempts to forcibly remove the alarm but again is unsuccessful.

She then proceeds to the Milwaukee tool aisle where she is seen placing two (2) power tools and two (2) batteries into the tote bag. The female then reunites with the male she entered the store with, who at this time has a shopping cart. Employees on scene stood near the entrance to prevent the theft. Seeing this, the male and female abandon the shopping cart and tote bag and exit the store and flee on foot towards Giant Eagle. After reviewing camera footage with ██████████, I confirmed these individuals were Brittany Bailey and Isiah Jones (co-defendant) from the Giant Eagle incident.

Itemized list:

  1. De-Walt 20V X -SKU 885911431200 – unit price $349.00
  2. Wyze Door Bell-SKU 859696007981 – unit price $49.98
  3. Milwaukee M12-SKU 045242615742 – unit price $199,00
  4. Milwaukee M12-SKU 045242615742 – unit price $199.00

  6. HD Rubag – sku 390065 – unit price $2.47

Employees recovered these items which totaled eight hundred and eighty-eight dollars and forty-five cents ($888.45).

Through the course of this investigation, I was in contact with Officer Capobianco of the Ross Township Police Department. Officer Capobianco was also investigating these individuals for a theft at the Ross Township Home Depot but had yet to identify them. I relayed all information to Officer Capobianco after positive identification was made.

A review of Bailey’s lengthy certified criminal history shows a total of four (4) retail theft convictions.

Bailey also has active arrest warrants out of Pittsburgh Police Department (OTN G-917522-4) for retail theft FTA and Boardman Police Department (State of Ohio – PD phone number ██████████).

Presumption of Innocence: A presumption of innocence means that any defendant in a criminal trial is presumed to be innocent until they have been proven guilty beyond a reasonable doubt in a court of law.
