Affidavit of Probable Cause
On 01/10/2023, Scott units were dispatched to ███████ Worcester Dr for a theft report. I arrived on-scene and made contact with the victim, ███████. ███████ stated that someone drained approximately $40,000 from her bank account and she believes it was her son-in-law Brian Donahue. ███████ showed me her bank statements from her Citizens Bank checking and savings accounts. They showed that between the dates of 10/06/2022 and 01/09/2023, there were 86 transactions out of her checking account ranging from $5.00 to $2,100.00 to Cash App, totaling $41,799.00. Out of the 86 transactions, 82 of them had the name Brian in the transaction. In the savings account, there were 5 transfers to the checking account from 12/16/2022 to 12/27/2022, totaling $23,000.00. ███████ stated that she has never had a Cash App account and never transferred any money from her savings to her checking account. ███████ stated that she used to live with Donahue and her daughter, Catherine. When they lived together, she had given Donahue her debit card and PIN number at times to go to the store and buy things. ███████ stated that she believes this is when Donahue gained access to her Citizens Bank account. The transfers from ███████’s savings account to her checking account were done by telephone transfer.

On 01/18/2023, a search warrant was issued by MDJ Stephens to Block, Inc. (Cash App) for the account information in this case. The search warrant was sent to Block, Inc on 01/19/2023 and returned on 01/24/2023. In the information received in the return, it showed the Cash App account that accessed and withdrew the funds from ███████’s checking account was registered to Brian Donahue. The results also showed the account had 86 deposits from ███████’s checking account totaling $43,895.00. The results showed 22 withdrawals to Bank of America account ending in ████, totaling $17,691.48. There were also 18 withdrawals to Dollar Bank account ending in 7141, totaling $7,042.30. The rest of the funds were sent either by direct payment through Cash App or by transferring funds to another Cash App user.

On 01/27/2023, 3 search warrants were issued by MDJ Stephens to Bank of America, Dollar Bank, and Citizens Bank. The Bank of America and Dollar Bank search warrants were based on the information received ·tram the initial Cash App search warrant and were served on 01/27/2023. The Citizens Bank search warrant was to find information on the unauthorized transfers from ███████’s savings account to her checking account which was served on 01/28/2023.

On 02/10/2023, the Bank of America search warrant results were returned. The results showed that the Bank of America account ending in ████ (card number ending in ████), is registered to” OBA ELLSYD ROOFING BRIAN DONAHUE SOLE PROP”. The account was also registered to the date of birth, social security number, and home address of Brian Donahue. The account statements showed Donahue’s account received the 22 deposits from Cash App that were shown in the Cash App records.

On 02/16/2023, the Dollar Bank search warrant results were returned. The results showed that the Dollar Bank account ending in 8101 (card number ending in 7141), is registered to Brian D Donahue. The account was also registered to the date of birth, social security number, PA OLN, and home address of Brian Donahue. The account statements showed Donahue’s account received 18 deposits from Cash App that were shown in the Cash APP records.

On 02/23/2023, the Citizens bank search warrant results were returned. The results included the checking account and savings account statements from October 2022 to January 2023.
