Affidavit of Probable Cause
I, Ofc. LEWIS and Ofc. Fagnelli responded to a call for a stolen phone pinging at ██████████████.
The victime, one ███████ stated that she was at the North Versailles Walmart on Tuesday, 2/21/23 at approximately 2000 hours, when her iPhone 13 fell out of her pocket. Wallace stated that she and a Walmart employee had tried to track the phone down in the store that night but were unsuccessful. Since that time, Wallace stated she has replced her phone and is upon viewing her “find my iphone” app she observed the phone on 2/24/23 at ██████████████, Wilmerding, Plum, Muraysville, New Kensington, and back to ██████████████ today, 2/25/23.
Upon arrival at ██████████████ this morning at approximately 8:18 a.m. I spoke with a neighbor who stated that someone was home next door and that they drove a grey Hyundai sedan bearing PA registration ███████. The vehicle owner is ██████████████ with an address of ██████████████, New Kensington, PA 15068.
I will apply for a search warrant based on the facts and circumstances leading me to believe the individual at ██████████████ has possession of the missing iPhone 13.
On 2/25/23 at approximately 1407, I, Ofc. LEWIS, Ofc. AGNELLI, Chief FARALLY, Ofc. LOWDEN, Ofc. TERRY executed a search warrant on ██████████████. After knocking and announcing, we used a key obtained from the landlord to enter the residence.
On scene were ███████, one Eleanor Mcallister, and one ███████. ███████ was observed in the kitchen. I ran her ID through dispatch and she came back with a warrant out of Westmoreland County. ███████ was placed under arrest.
Mcallister and ███████ were in the back bedroom with the door closed. Ofc. Terry gave commands for the two to come out. We entered the room and detained both females. The females were placed in the living room on the couch with Ofc. Fagnelli attending with them.
Mcallister stated she had the iPhone and advised it was located in a purse. We searched numerous purses and bags with negative results. While searching for the iPhone, in plain view we observed 8 needles, a spoon with suspected crack cocaine, 3 bundles of suspected heroin labeled”babymakers” and “overtime”, 3 gabapentin capsules, 1 roach of suspected marijuana, 1 bunch of copper with suspected crack cocaine residue, 2 retail scanners, and one Walmart sticker labeler, and the stolen iPhone which was in the front pocket of the purse.
The retail scanners and labels are indicative of retail theft activity. They are used to relabel/reprice items as clearance, as the labels are marked “clearance” as well as switch and adjust prices.
Mcallister was placed under arrest and read her Miranda rights. Mcallister stated she had picked up the phone in Walmart.
The code enforcement officer, Al Hussey was called out due to there being 8 dogs in the residence. The ordinance states only 2 dogs can be present in any residence in Wilmerding Borough at one time.
I transported Mcallister to the station and searched her. Officer Caruso arrived on scene and transported ███████ to the station. Westmoreland County sheriffs came to transport ███████. Mcallister was taken to Allegheny County Jail.
